This took after the decision conveyed by the trial Judge, Justice Taiwo expelling the movement to suppress the charges and requesting blamed people to take their supplication.
The pair are standing trial over aĺeged criminal intrigue, seizing, unlawfull ownership of 4 riffles and live ammo and murder of a Young Shall Grow driver.
The offenses were aĺlegedly dedicated inside the Lagos ward .
Evans through his attorney Ogungbeje had tried to subdue the charges, saying that the charges are uncouth and damaged.
As per him, comparative charges had been documented by the arraignment in a similar high court against the litigants, previously Justice Oshodi sitting at the Lagos High Court, Ikeja. Ogungbejesaid that the charges will make the wòrk of barrier long and awkward.
Lagos State had documented a resistance saying that the cases are on various actualities with various casualties. Including that the litigants partook in different violations, at various circumstances, spots and casualties inside a similar locale.
In its governing, the Court held that "having deliberately viewed as all issues. The charge does not annoy against Section 152 and 153 of ACJL, Lagos, including that the check of ownership of guns are not damaged, once the charge fulfilled the law.
"There is adequate verification to continue to trial. There is something worth taking a gander at. On fiat from AGF, fiat has been recorded with charge dated 30 Jan. 2017 gave to AG Lagos writing him to under take arraignment. The pplication is misjudged, needs merrit and rejected", the Court held.
The case was deferred till fifteenth December, 2017.
It will be reviewed that Evans had before confessed to comparable charge before Justice Oshodi just to later change his supplication to not blameworthy.
Evans challenged the Attorney General ( AG ) Lagos State to prove the case against them
